If Smith's appointment is unconstitutional then how would they expect this to win on appeal because eventually it would go to the SCOTUS. Seems like a big waste of time and money at this point.

Good. SCOTUS might increase the scope of the decision to all special counsel investigations. Make them all appear before Congress before they start investigations and then get Congress to fund them.

Congress could have obviated this problem via a special counsel or independent counsel statute. They chose to do nothing. Garland could have prevented this problem by choosing a US Atty already confirmed by the Senate, he chose not to do so. Yeah, it’s Judge Cannon’s fault.

It takes time to write an impermeable 93 page ruling with complete citations. The Florida appeals court will read this ruling and not take the case.

After the judge’s finding that smith is illegitimate, how does he even have the power to appeal this?

You mistate the reason Jack Smith was unlawfully appointed. He was a private citizen and Merrick Garland does not have the authority over private citizens, only over DOJ officers.
