New York is a one-party consent state in regard to recording an in-person or telephone conversation. Ergo, Cohen was within his legal rights to record his conversation without notifying Trump.

I don't think Michael Moore is correct. Yes, it's not 100% that MC's testimony will be fullproroof (nothing ever is). The jury will be looking at "for all probability" this testimony is holding up
